Referral Policy

Last updated 24 April 2025

At PublicSquare, we value our partnerships with businesses that refer clients to our real estate and service offerings.

This page sets forth the referral policy for PublicSquare Technology Pty Ltd ("PublicSquare"). This Referral Policy applies to all referral activities conducted with PublicSquare in Australia.

  1. PublicSquare may receive referrals to prospective buyers of real estate or PublicSquare services. Referrers must be registered businesses; PublicSquare does not accept referrals from individuals. All referrers are expected to comply with this policy and any formal agreements with PublicSquare.
  2. Referral fees are determined as per formal contracts or agreements between PublicSquare and the referrer. Referrers are responsible for reviewing their agreements with PublicSquare for specific details, terms, and conditions regarding referral fees.
  3. Referrers must ensure compliance with all applicable federal and state laws, as well as the rules and guidelines of the Australian Competition and Consumer Commission (ACCC). Depending on the state and licenses under which they operate, Referrers may be required to disclose referral fees to referred clients.
  4. PublicSquare does not condone any illegal or unethical business practices, including spam. Referrers must obtain permission from prospective referees before contacting them about PublicSquare offerings.
  5. PublicSquare uses URL tracking links and cookies to attribute referrals accurately and ensure referrers receive their rightful fees. However, PublicSquare is not liable for any malfunction, disabling, or overwriting of tracking links or cookies by referred clients or third parties. Referrers are encouraged to contact PublicSquare if they encounter issues with tracking.
  6. PublicSquare endeavours to reward all referral partners and affiliates fairly and in accordance with their agreements. However, PublicSquare does not guarantee that referred prospects will become clients. All referred prospects must meet PublicSquare’s eligibility criteria to generate referral fees. Referrers accept that not all referrals will result in successful transactions; Referral fees are only payable when referred prospects meet PublicSquare’s eligibility criteria and complete the required actions (e.g., purchasing a property or service).
  7. PublicSquare is committed to protecting the privacy of referrers and referred clients. Any personal information collected during the referral process will be handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). Referrers must ensure they have the necessary permissions to share referee contact details with PublicSquare.
  8. PublicSquare does not inflate home prices—Home prices are set by builders, aggregators, or service providers from whom PublicSquare sources property availability and details.
  9. PublicSquare provides information about homes and services for referrers to distribute. PublicSquare accepts no liability for any erroneous or incomplete information regarding such real estate offerings.
  10. PublicSquare accepts no liability for any losses, damages, or costs incurred by referrers or affiliates in the course of marketing PublicSquare’s offerings to their networks. Referrers undertake referral activities at their own risk.
  11. PublicSquare reserves the right to update this Referral Policy at any time to reflect changes in our practices or applicable laws. The most current version of the policy will be available on our website, and referrers are encouraged to review it periodically.
  12. Referrers are encouraged to share this Referral Policy or relevant details with prospective referees to ensure transparency.
